Even if Donald Trump loses the upcoming election, he could go down in American history as the most transformative one-term President since James K. Polk. If Amy Coney Barrett is confirmed by the Senate, President Trump will have fundamentally changed the Federal Judiciary. This change will likely last for a generation—or even longer.

The Democrats are unlikely to be in a position to reverse this progress. Even if they take back the Senate in 2020, the margin will be very narrow. This will prevent them from passing any major legislation. Democratic Senator Joe Manchin of West Virginia has already stated his opposition to ending the filibuster and court-packing.

With a stalled legislative agenda, this means that the Federal Judiciary will be left with making many of the important political decisions. State Republican Attorney Generals and conservative legal activists now have an opportunity to implement social policy outside of the traditional democratic process. The Left did this to us for years. We should return the favor.
